DUH: McDaniel's Ethics Reform Unformed
Dustin McDaniel promised to make ethics reform part of his agenda to push in the legislature, but as the session nears he apparently doesn't know what sort of ethics reforms need to be made. You read that right. Even though he's spent quite some time in the Capitol and supposedly sees the need for ethics reform, he doesn't really know what needs to be fixed...Sounds fishy to me. It sounds like he's been caught between saying things the public wants to hear and doing things his fat cat politician friends want.

Now, I'm probably the biggest fan of Wal-Mart you'll meet outside of Bentonville. I love, I mean LOVE, Wal-Mart. It is, without a doubt, the greatest store on earth in history. But I don't appreciate it when they cow tow to political pressure from people who are going to continue to hate and trash them.That's exactly what they did by "investing" in this wind farm. In and of itself, I have no problem with wind produced energy. I strongly oppose wasting taxpayer money on it. Wal-Mart isn't doing that, but an objective look at the costs versus the return would likely reveal that this was not a business consideration, so much as a political one.
Wally World, you don't have to have to give in to political pressure like this. Tens of millions of people vote with their dollars every day and you're winning without trying to buy favor from a noisy minority of bullies who are pressuring you to bend to their will. Don't give environmentalists any more credibility by giving in to their demands that you run your business by making considerations aside from what are good business practices.

I have heard from a number of different sources that Mr. Gwatney may have employed his murdered years before and stories range from insufficient workers comp for an injury on the job that caused the murderer great financial hardship to being fired over various disagreements. It's hard to say if any of these rumors are true, although the first one mentioned seems to be given the most credence by those who related it and offers a stronger motive than being fired years ago. Mr. Gwatney was a successful businessman, so he doubtless has employed many people over the years and it's impossible not to leave a few with hurt feelings over the years.
Whatever the reason, the murder of Mr. Gwatney was senseless and a tragedy.

UPDATE: Back To School Sales Tax Holiday...On The Right Track
I've been talking about the need for the state to stop bilking Arkansas taxpayers, especially in this slowdown. No sooner were the words out of my mouth than I came across this story about Sen. Denny Altes, R-Fort Smith, who is proposing to some of the many nickel and dime taxes that most Arkansans don't know they pay because they're hidden in the cost of manufacturing.Way to go, Senator. Let's work on finding all these hidden taxes and eliminating them. The state has a surplus. It'd be nice if the taxpayers could say the same thing.

UPDATE: While Senator Altes is working to help alleviate the burden on taxpayers, his colleagues are not so eager. Even this modest concession has drawn lukewarm response from Senators on the Revenue and Taxation Committee.
An official with DFA estimated that Altes' proposal would cost a mere $1.6 million. Apparently, that's just too much for these greedy politicians to part with. Let me take this opportunity to remind them that this is OUR money, not theirs. It's time that politicians came to grips with the fact that it's better for the government to cut back than the taxpayers. After all, we pay all the bills: those we freely agree to and those that politicians force on us.

Legislators Discuss "Economic Development"...No Mention of Significant Tax Cuts
First, I have to give Tracy Pennartz, D-Fort Smith, credit for suggesting tax credits for certain construction projects and the mayor of Starr City's suggestion that clean coal is a good idea, but the other proposal was just boondoggle.Robert Moore, D-Arkansas City, has the crazy idea that what this state needs is a walking trail...
I'm serious. He wants $3 MILLION for a walking trail, no doubt in or near his district. How many hundreds of miles of trails does Arkansas already have? Has anybody measured the return that these walking trails bring for the money we've invested? Now, don't get me wrong. I love nature and Arkansas's trails just as much as the next guy, but there are a handful of obvious reasons why this is a bad idea.
1. We're in an economic slump and building a walking trail in an area where people are not likely to go on vacation, anyway, is not a good use of taxpayer money. It would be far better if that money was returned to the taxpayers than wasted on a supposed economic development trail.
2. It would not generate as much revenue for local businesses than it would cost, especially once you consider the ongoing cost of maintaining it. Dressing up his walking trail boondoggle as economic development is an insult.
Rep. Moore should've had the guts just to say that he wants a walking trail for his district and he wants the taxpayers to pay for it. He's trying to make it sound like we need it, though, and that it will generate business for the state. Whatever business it generates will be negligible. Most of the use will, no doubt, come from people who already live in the area. The South is dotted already with trails that snake through similar terrain. It is highly unlikely that anybody other locals and the very small group of people who like to tick off trails on a list will utilize it.
Rep. Moore's boondoggle is another serious misuse of taxpayer money and another violation of trust we put in our legislature to be good stewards of our money. Under normal economic circumstances, I might be more inclined not to oppose something like this, but pretending it will have economic benefits that outweigh the cost, initial and ongoing, in tumultuous economic times is an insult.
Rep. Moore is running for the speakership and this reflects poorly on his judgment and scruples as a candidate.
If he and the rest of the legislature are serious about economic development, especially in such troubling times, I suggest that they do the right thing and drastically cut taxes, especially the many nickel and dime taxes that choke various businesses and hide costs from consumers. The taxpayers of Arkansas desperately need and deserve a massive budget increase. I think it's only fair that the state government take a massive budget cut to accommodate that. If politicians are actually interested in being public servants, it's time that they serve the public and stop treating us like we exist to serve them and provide them with revenue.

During the recount, the following vote totals changed:
Paper ballots:
Precinct 91 - increased by 2 votes for Edwards
Absentee Votes - decrease by 1 vote for Edwards
Electronic ballots:
Precinct 58 - 21 votes were not counted on election night. The results were 10 Edwards, 11 Eichler
Early Voting: Decrease of 4 votes for Edwards and decrease of 1 vote for Eichler
We congratulate John Edwards on his election as the Representative for District 38.
We also thank the Pulaski County Election Commission and the Pulaski County Clerk and their staff for their cooperation and hard work during this recount procedure.
During our review of the voting in our election we found the following issues that we have forwarded to the election commission as areas of concern for future elections:
1) In precinct 108, at least 10 voters were provided and voted the wrong ballot.
2) Instances during early voting of voters who provided out of district and/or out of county addresses and were still able to cast a ballot in District 38. Although we understand certain voters may list a different temporary address than a permanent address, we feel this issue should be closely monitored in the future to insure that voters receive the correct ballot during an election.

I'm sure that gem would be as widely used as Little Rock's trolleys, which, to date, has been most notable as transportation for armed robbers and carjackers.

Huckabee Needs To Go Back To Seminary...Gets Basic Bible Facts Mixed Up in New Book
A reader sent me this just now and I didn't know whether to laugh or cry. As a Christian I am truly disturbed by the way so many Christians blindly follow Mike Huckabee because he was a preacher. I am even more bothered to find that Huck can't even get basic Bible facts right.Thanks to the observant reader who was quick to catch the remarkable mistakes Huck made.

I'm typing this from my blackberry so I apologize for any glaring errors you might see in this email. I should have waited until I got home to do this research, but the internet connection on my phone seems to have worked just fine.
Looks like Huckabee needs to go back and actually get that seminary degree he doesn't have. In his latest book Huckabee says,
“I lamented that so many people of faith had moved from being prophetic voices — like Naaman, confronting King David in his sin and saying, ‘Though art the man!’— to being voices of patronage, and saying to those in power, ‘You da’ man!’
The passage of the Bible that Huckabee is referring to is II Samuel chapters 11 and 12. Chapters 11 and 12 of II Samuel tell the story of David and Bathsheba. In case you are unfamiliar with the story I've posted it below.
Huckabee is getting the details of this story mixed up. Naaman didn't confront King David and say "though art the man". First of all, the phrase is, "Thou art the man", but excusing that mistake; King David was confronted in his sin with Bathsheba by Nathan not Naaman. Nathan came to David and told him a parable about a rich evil man and a poor loving man and used the moral of the story to convict King David of his sin. Naaman has nothing to do with King David and the story of Bathsheba.
Naaman was a Syrian general who had leprosy. God healed him when he bathed himself in the Jordan River. Naaman's story is told in II Kings and takes place many years after King David's death in the time of Elisha.

$53 MILLION Scholarship Surplus Comes to Light, AFTER Lottery Proposal Wins
Could the $53 MILLION possibly be unused because of shortage of unqualified (academically) students? I can tell you from experience, having attended a state university, that college classrooms are already full of people who aren't qualified to attend college.
Meanwhile, with a $53 MILLION horde of taxpayer money, the new head of the Higher Ed Dept. is proposing further loosening of academic standards for needy students. Why do we allow such bigotry against poor kids, by seeking to lower academic standards instead of having faith that, if we try, they CAN achieve higher goals academically? Can we please stop insulting poor kids? If they're not doing well academically in high school, why do we allow this silly notion that they should go to college, instead of deciding not to let them down academically before they near high school graduation?
I guess I' was under the foolish notion that "scholarships" were awarded for scholarly achievement, not just being poor. Why don't we hold educators responsible for allowing these kids to be passed from grade to grade without learning? Either these educators don't have faith in the ability of poor kids or they're lazy. Either way is absolutely unacceptable.
This article will get your blood boiling if you're under the silly impression that college exists for the sake of education and not just social promotion. Employers should be very wary about locating in Arkansas considering that our colleges are being turned into student mills. We've been force fed the idea for years that higher education is the key to attracting business to the state. Unfortunately, people use the word "education" with a straight face. Why can't kids qualify for these scholarships? Why did Tennessee, with a lottery-funded scholarship program, have to lower academic standards for scholarships after four years because over two thirds of the students in the program could not maintain the required GPA?
The answer is because the state is cheating students out of an EDUCATION, which I assumed was the goal of education. The state is also cheating taxpayers out of our money by allowing this abominable situation to go on and then expecting us to pony up more money.
On a side note, does anyone wonder why we can't get a bigger tax cut that $30 MILLION, while we taxpayers languish in a struggling economy and bureaucrats horde OUR money??? Even better, there's talk of a new tax on alcohol, again with the divide and conquer method of taxation...

Governor Beebe Proposes 1 Cent Sales Tax Cut
"Officials said cutting the tax from 3 cents to 2 cents would cost the state about $30 million."Soooo, the governor is proposing a $4.5 BILLION budget and he's ever so gracious to spare us some change.
Wow, $30 million. Thanks so much. That's not even 1% of the state's budget.
Am I missing something or didn't the governor promise two years ago, when he was running for governor, to ELIMINATE the grocery tax? Meanwhile, the state has continued to run massive surpluses and he wants us to be grateful for another penny discount, a discount that still doesn't meet the promise he made two years ago.
It's high time that the governor and the rest of the ruling class in Little Rock realized that we, the taxpayers do not exist to generate revenue for them. Arkansans deserve a MASSIVE budget increase, i.e. a massive, significant tax cut.

Rainy Day Fund: What About the Taxpayers, Governor Beebe?

Mike Beebe said Tuesday a balanced budget proposal he plans to present to lawmakers this week probably won't go into specifics on a "rainy day fund" he wants to set aside for financial downturns."I'm not asking for a bailout. Wishful Thinking/Good Idea About Annual Sessions From Under the Dome
Rep. Steve Harrelson, D-Texarkana, has a pretty good idea about how to run annual sessions, i.e. to limit the activity of the new even year sessions to approving the budgets established from the regular session. The problem is that there's no need for annual sessions if that's all the Ledge does. Unfortunately, there are obviously grander plans for the new annual sessions. It is constitutionally impossible to prevent the legislature from doing anything when they're in session.Here's the link.

Legislators Pick Seats, Committees
If you haven't heard, the Capitol is buzzing with activity. Legislators and legislators-elect are on the Hill this week picking seats and committees, as well as caucusing in preparation of next year's session. They're also enjoying the largesse of lobbyists, which really exciting, I'm sure, for freshmen.
Misunderestimated: Sanders and Me on the Bush Legacy
David Sanders' latest column offers one of those rare occasions when I must depart from Arkansas's premier Conservative columnist.I certainly agree with David's column about the damaging effects of President Bush's acquiescence to out of control growth of the federal government. And I certainly recognize Morton Blackwell's prescience about President Bush.
I do not agree with David's disparaging thoughts about the War in Iraq. The standards by which the War has been measured are unprecedented in the annals of warfare. An objective comparison to other American wars would show that the real downfall was in the impatience of the American people and a willingness to accept completely erroneous metrics for success.
President Bush was right to liberate Iraq. 30,000,000 people are free as a result and the world is safer. A brutal dictator who harbored terrorists and fostered terrorism was deposed and brought to justice. The most important lesson from September 11 has been lost, but invading Iraq was a direct step by the president to act on that lesson. The lesson is that we cannot wait to be attacked. Political sabotage, hallmarked by focusing on the realities of war as insurmountable and unheard of odds, has served to sour American sentiment against the need to deal with terrorism.
I also take umbrage to armchair quarterback complaints about Hurricane Katrina, which give a pass to the local authorities who held legal authority and responsibility to be the first responders. The catastrophy centered on New Orleans where thousands of citizens chose not to take responsibility for themselves. The rest of the Gulf Coast was just as devastated, but the disaster relief efforts there were not hamstrung by the need enormous disaster rescue efforts experienced in New Orleans.
Criticisms about Hurricane Katrina, like criticisms of the War in Iraq, echo democrat talking points which have become conventional wisdom, part of the political vernacular which roll off the tongue with ease. While common, these criticisms are, well, common, in the sense of being too facile, throw away lines that are accepted and expected.
History should remember President Bush differently than it will. He was wrong to allow such unbridled spending. It is forgotten that President Reagan made the same choice, to protect America's national security in exchange for relenting to Congress' insatiable desire to grow government. President Reagan, it is true, did not act as President Bush largely has, as if the spending was acceptable, but he made the same choice nonetheless.
Not opposing McCain-Feingold, pushing medicare prescription drug benefits, and a well-founded litany of other complaints certainly vindicate Morton Blackwell's prediction and some of David's criticism, but there is much for which we should be thankful. I know I am.
David, like Morton, has impeccable Conservative credentials. His analysis is more than indispensable to the Conservative Movement in Arkansas, so it pains me to depart with him on part of this column. I'd be very interested in reading a counterpoint from David about the positives of President Bush's administration.
He could start with a vibrant growing economy which has, remarkably, been forgotten because of democrat engineered meltdown. His tax cuts, income and capital gains, were pivotal to leading America out of the Clinton Recession.
Perhaps he could finish with a discussion of President Bush's commitment to nominate a myriad of superb jurists to the federal bench, capped by the successful accession of Justices Roberts and Alito, not to mention the numerous others who never made it past the vicious vivisection of democrats, led by our future vice president, and the treachery of a number of Republicans, led by our former nominee.
No, history may not be kind to President Bush, but much blame has been laid at his feet which is not borne out by the facts and much that he did has been marred by hyper-partisan attacks, for which he receives scorn where praise is due. His presidency was not perfect, but it was not nearly as imperfect as it will be remembered. President Bush, it cannot be doubted, loves America. While misguided, in some cases, it cannot be disputed that much of what he did was out of an abiding commitment to do the right thing. And we are all safer and better off for it, whether we recognize it, or not.

Kerry as Secretary of State? Why Not? He's Got So Much Going For Him.
He speaks the language of diplomacy, French, fluently. I've often said that it's appropriate that French is the language of diplomacy, since the French are so practiced in surrender. For Kerry this is especially apropos, since he played such a pivotal role in securing the victory of the Communist North Vietnamese, not only in his devious and deceptive protests, but also in his eager efforts to aid the Communist North Vietnamese meeting with their agents in Paris. Indeed, his efforts are honored in Hanoi in a museum to the heroes of Communist victory in the Vietnam War.So, given Barack Obama's commitment to America's diminution and defeat, John Fing Kerry is eminently qualified for the job.

Obama Wins...Not Much to Say About That, Tonight...A Few Bright Spots in Arkansas
1. The adoption amendment passed.
2. Terry Rice appears to be on his way to drubbing the traitor Bill Walters.
3. The Fab Five: Jane English, Ann Clemmer, Stephanie Malone, Karen Hopper?, and Andrea Lea are five new, female Republican House members. I don't know all of them, but I know good things about most of them.
4. John Burris' election to the state house is one of the brightest spots, as is Rep. Brian King's overwhelming reelection against a radical opponent. Another bright spot is Duncan Baird of Springdale, who was unopposed in the general. The same is also true of Cecile Bledsoe.

To borrow a phrase from a friend, "in my humble and accurate opinion", America has faced no greater danger in my lifetime than the danger presented by the candidacy of Barack Obama.
Like the man who was no longer concerned that he was losing his hair when he discovered he was losing his sight, my growing concern about our country's drift toward socialism is gone. If Barack Obama is elected President, there will be no drift. We'll be pushed into a head-long race off that frightful precipice which Karl Marx himself accurately described as the transitional stage between capitalism and communism.
What an extraordinary irony it is that the first black candidate nominated for the office of President of the United States by a major political party would be an imperious proponent of the new slavery in America – where the federal government is the slave owner, American business picks its cotton and slaughters its hogs, and the entitled wait subserviently at the government's back porch for their meager bowl of redistributed wealth.
Obama's popularity is a symptom of the potentially fatal malady that infests our society from the media to the ministry – our willingness to accept the superficiality of the attractive and articulate, and our Hollywood-induced inability to recognize and rally around courage and integrity.
While I have your attention as far as this paragraph, let me also say that I have grown tired of the CEO bashing in our country. For every CEO who has abused his/her privilege, one could find a thousand small business owners ("CEOs") who have risked everything and waded neck-deep through the smelly swamp of self-preserving bureaucrat-infested regulations; CEOs who normally work 70-80 hours/week, take their work with them on the rare vacation, and who pay their employees before (and if) they can pay themselves. Those are the Americans who create jobs and opportunities for wealth for any American who is willing to work - and who will be destroyed by the Obama-advocated Marxism.
Like curious but disengaged spectators at a car wreck, shall we stand idly by as the American dream dies, shake our heads in despair – and do nothing?

NRA Corrects Mistake: Rep. Jon Woods Receives "A" Rating
I received the following earlier. It's a correction from the National Rifle Association, who incorrectly issued Rep. Jon Woods, R-Springdale, a "C" rating, thinking that he was Rep. Jeff Wood, D-Sherwood.Rep. Jon Woods, it should be noted, is a lifetime member of the NRA, a hunter, and a member of the Sportsman Caucus.
Rep. Jeff Wood was given his "C" rating for voting against a measure to propose a constitutional amendment to define and protect hunting in Arkansas. The vote was held in the State Agencies Committee, which was deadlocked at 10-10. Rep. Jon Woods was not a member of the committee.

Redistribution
Received the following from my sister the other day. It's illustrative, but didn't actually happen. It will happen to us all if Obama wins.---
Yesterday on my way to lunch at Doe's, I passed one of the homeless guys in that area, with a sign that read 'Vote Obama, I need the money.'
Once in the Doe's my waiter had on a 'Obama 08' tee shirt.
When the bill came, I decided not to tip the waiter and explained to him while he had given me exceptional service, that his tee shirt made me feel he obviously believes in Senator Obama's plan to redistribute the wealth. I told him I was going to redistribute his tip to someone that I deemed more in need--the homeless guy outside. He stood there in disbelief and angrily stormed away.
I went outside, gave the homeless guy $3 and told him to thank the waiter inside, as I had decided he could use the money more. The homeless guy looked at me in disbelief but seemed grateful.
As I got in my truck, I realized this rather unscientific redistribution experiment had left the homeless guy quite happy for the money he did not earn, but the waiter was pretty angry that I gave away the money he did earn.
Well, I guess this redistribution of wealth is going to take a while to catch on, with those doing the work.

As of November 5, 2008, when President Obama is officially elected into office, our company will instill a few new policies which are in keeping with his new, inspiring issues of change and fairness:
- All salespeople will be pooling their sales and bonuses into a common pool that will be divided equally between all of you. This will serve to give those of you who are underachieving a fair shake.
- All low level workers will be pooling their wages, including overtime, into a common pool, dividing it equally amongst you. This will help those who are too busy for overtime to reap the rewards from those who have more spare time and can work extra hours.
- All top management will now be referred to as the government. We will not participate in this pooling experience because the law doesn’t apply to us.
- The government will give eloquent speeches to all employees every week, encouraging it’s workers to continue to work hard for the good of all.
- The employees will be thrilled with these new policies because it’s good to spread the wealth. Those of you who have underachieved will finally get an equal opportunity; those of you who have worked hard and had success will feel more patriotic.
- The last few people who were hired should clean out their desks.. Don’t feel bad, though, because President Obama will give you free health care, free handouts, free oil for heating your home, free food stamps, and he’ll let you stay in your home for as long as you want even if you can’t pay your mortgage. If you appeal directly to our democratic congress, you might even get a free flat screen TV and a coupon for free haircuts (shouldn’t all Americans be entitled to nice looking hair?) !!!
If for any reason you are not happy with the new policies, you may want to rethink your vote on November 4th.

There is a lot more to this referendum than what the title implies. It is basically a power grab for property rights.
The following quote from an AP article explains the problem. "The Arkansas Wildlife Federation announced Thursday its opposition to a November ballot measure that would give a state agency the authority to issue $300 million in bonds for water projects. The group said the measure also would give the Arkansas Natural Resources Commission authority to take title to or determine the use of private recreational lakes, stock ponds, irrigation reservoirs, and certain rivers." A friend who has researched this issue for years says that this referendum along with Act 631 would give bureaucrats in the Arkansas Natural Resource Resources Commission power through imminent domain to take title to people's private water sources.

• Proposed Constitutional Amendment 2 would require the General Assembly to meet every year. The constitution now requires them to meet every two years. I fully agree with this quote attributed to Mark Twain, "No man's life, liberty or property are safe while the Legislature is in session." Once every two years is often enough to go through that fearful time. Besides it will only cost Arkansans more money to have legislature meet every year.

In 2005 legislators introduced a total of 3,176 bills; and in no year in recent history have they introduced less than 2,643 bills. For Eagle Forum the 60 days every other year (nearly always extended by a number of days) when the Legislature is in session is the most intense time in our lives. We are constantly working to ward off all the laws the liberals come up with such as trying to pass the Equal Rights Amendment from last session, hate crime laws designed for homosexuals, and laws to give in-state tuition and scholarships to illegal aliens for example.

Gov. Bill Halter. It is listed on Arkansas Voting Ballot as “A constitutional amendment authorizing the General Assembly To Establish, Operate, and Regulate State Lotteries.”
Family Council reports that “Arkansas courts have interpreted Arkansas’ ban on lotteries to ban casinos and other types of gambling as well. This is why we don’t have casinos. Since this amendment allows the state to run lotteries, it allows the state to run casinos as well."
There are many more reasons to vote against this amendment to the constitution, but the one given is enough said.
