Grumblings In House About Percy Malone Sending Out Christmas Gifts...While Malone Continues To Reap Benefits From Massive State Contracts
I corresponded yesterday with disgruntled legislators about Sen. Percy Malone, D-Arkadelphia, playing Santa Claus sending out gifts other legislators. The reaction I heard was of palpable disgust at the legislator who single-handedly has reaped more than any other legislator from the taxpayers of Arkansas.Malone has largely been able to escape scrutiny for the numerous state contracts he holds. It is doubtful that he would have been able to reap the rewards he has if it weren't for his senate seat. If I understand correctly, legislators aren't allowed to hold jobs with the state, yet Malone has been able to skirt this prohibition by arranging lucrative contracts for himself at taxpayer expense.
Malone sending out gifts was perceived by his fellow legislators as lobbying by Malone, who is very unpopular among many legislators, who question the ethics of dealings with the state.

I've heard for quite some time that Congressman Vic Snyder might not run for reelection as he turns his attention to his growing family. It would certainly make for some interesting speculation as to who might replace him. That would be a real race. Would republicans have a shot this time around? Let's remember that Christmas isn't about presents or Santa Claus. It's about birth of Christ. The Son of God became a man, died for our sins and rose from the dead so that we could have eternal life. Luke 2:1-20

Scandal, Vengeance, and Fat Cats: Barry Hyde Flying High
Rep. Barry Hyde, D-North Little Rock, got his way on a vote recently to make the Arkansas Department of Aeronautics the only state agency that is required to report its flight activities monthly to a legislative oversight committee. The move was the second effort to hamstring the department which denied a grant to repair damaged hangars at the North Little Rock Airport earlier this year, the airport where Hyde stores his personal plane. Turns out the airport had insurance, as you might expect.His first attempt to punish the department came in the form of a move to defund the department's airplane, a move for which he has offered no explanation. This kind of tyrannical browbeating is very disturbing, especially considering that it appears that he was after payback for the department declining to give the grant.
It really gets interesting given the rumors that have been circulating for quite some time about Hyde using his plane to fly Speaker-elect Robbie Wills around the state during his bid to win the speaker's race. Wills of course won and Hyde has been named to an important committee chairmanship by Wills. The question of Hyde's aerial chauffeuring of Wills was brought up in the committee hearings last week by Sen. Ruth Whitaker, R-Cedarville, who repeated the same rumor with less detail.
If Hyde did fly Wills around, the ethical questions involved are troubling, if unclear. He obviously could not fly candidates around gratis in a normal election, since the in-kind contribution would probably exceed contribution limits. Should the same rule not apply to the speaker's race? Currently I am not aware of any special rules that would apply, like campaign finance rules, except for rules that govern the receipt of gifts. Seldom are the gifts to legislators received from other legislators, as legislators prefer to be on the receiving end of gifts.
Those ethical questions, coupled with his attempts to take out the Department of Aeronautics at the knees, offer a troubling glimpse into the kind of behavior Rep. Hyde thinks is acceptable for a legislator. His modus operandi of seeking revenge and, possibly, greasing the skids and skirting state ethics laws is chilling. He appears to think he's some sort of dictator who can do what he wants, both by exacting revenge and by flaunting what might be an ethical loophole by behaving in what appears to be what one could fairly describe as unethical, but uncharted, behavior.
I'll keep you posted about this as it develops. Who knows if this is the end of Mr. Hyde's revenge and it's going to be very interesting to see if he was taking advantage of Sen. Whitaker's slip in describing his flights as occurring during public (as opposed to intra-legislative) elections. He was very careful in his wording in how he responded to her. That leads me to believe that the rumors that have been circulating for some time are true about him providing Speaker Wills with use of his private plane.

Big Brother Is Here To Help
State Senator Kim Hendren biennially runs nanny state legislation aimed at helping us Arkansans who are too stupid to live our lives without the government.Once again, he's running his bill requiring only hands free cell use while driving law. FYI: I, like everybody I know, have been driving while using a handheld cellphone for years and I've never had an accident while using it. I think you'll find that the vast majority of people who have accidents while using a cellphone are among the people who are already having more accidents anyway, but who cares about that? We have people who need to be controlled.
The motorcycle helmet law was just repealed ten or more years ago. Now, I really don't see why motorcycle drivers can't endanger themselves at their own risk.
Now, I know this won't smooth things over with Senator Hendren, but I do, personally, like him a good deal. I just don't see why Arkansans should be forced to live their lives a certain way because a senator says so.

Conservative Icon Paul Weyrich Passes Away at 66
I was saddened to hear that Paul Weyrich passed away today. He had been in poor health for years. I had the pleasure of meeting Mr. Weyrich on a number of occasions over the years. I have to say that the last time I saw him, which was several years ago, I was stunned by his frail condition. I was not surprised to find him still resolute and steadfast in his principles. Last, but not least, Morton Blackwell, who knew him well, offered a fitting eulogy to his longtime friend. If you really want to know him well, read Morton's thorough tribute.
Mr. Weyrich was 66. His lived a profound life and left a legacy for Conservatives as one of the original founders of the Conservative Movement. He was, specifically, a founder of Heritage Foundation, the original and premier Conservative think tank, and the Free Congress Foundation. On a strategic level, he thought in terms of the grand scheme of the Conservative Movement, looking to create a system for disseminating Conservatism to the American people, including promoting Conservatives in a media, which was once monolithically liberal.
We are all better for his life, though many never knew him or knew his name. The Conservative Movement is what it is in large part because of his vision and leadership.

UPDATE: Lincoln Responds To Griffin Challenge
Recently, former U.S. Attorney Tim Griffin suggested that he might run for U.S. Senate against Blanche Lincoln, specifically mentioning her wishy washy position on the pro-union card check legislation.No sooner was his suggestion published than Blanche decided she better issue a statement. Unfortunately, Blanche can't seem to muster anything more than another wishy washy statement. She can't quite bring herself to call this payoff to the Big Labor special interest by her party what it is. If passed, card check will radically tilt the playing field in favor of languishing private sector unions. Businesses will have almost no ability to respond to union "elections", which unions will be able to hold without notice.
According to Lincoln, card check isn't "necessary". That's a real tough stand, Senator. As usual, she left herself open to the possibility that she may change her mind. Saying card check isn't necessary is like saying that she doesn't support giving criminals the right to rob banks because it isn't necessary. Card check will allow unions to hold "elections" without notice, not just to employers, but also to 49% of the workforce. All they'll have to do is get 51% of the workforce to support forming a union shop and it's done. The employer and the other 49% need not know about it until it's over. The proper response is that this is terrible, not that it isn't necessary. Ugh.
Griffin barely mentioned his interest and Blanche is already running scared. Keep it up, Tim.

The standard for opposing this new plant is basically that it will hurt the environment. What's the evidence? Basically, "because we said so." The GLOBAL WARMING!!! hoax is the standard line. That's a debate which isn't being noticed by the media in Arkansas and is completely ignored by the kooks perpetrating it. These kooks are given a complete pass on the issue. The overwhelming evidence is to the contrary, but we're still subjected to this myth as gospel proof (minus the proof) that we should stop being Americans and living in an advanced civilization.

Legislators Bilking Taxpayers For More Personal Expenses
It's truly disturbing the way legislators view per diem and mileage as an entitlement. It's not a reimbursement for them. It's income that they maximize. Between those little perquisites and free meals from lobbyists, they make a LOT more than the average Arkansan realizes. They average over $30,000 per year in tax free income. That's more than the average Arkansan makes BEFORE taxes and that's not the half of it once you factor in salary and "office expenses".
I haven't heard yet if the mileage reimbursement has been adjust down since the price of fuel dropped recently, but I bet it didn't. Inexpensive Capitol Hill apartments, with free utilities, cable, and internet, are also a nice little perk.
Meanwhile, Arkansas taxpayers struggle to make ends meet in a struggling economy. No wonder these fat cats aren't in any hurry to turn back the generous amounts they take from us in taxes. We're keeping them in high style.

"Reducing the sales tax on groceries would narrow the sales tax base, which is not a good idea during the current recession..."
That's a paraphrase of what an economist said about cutting the grocery sales tax. He also asserted that it wasn't a good idea to enact a sales tax holiday. For whom are these tax cuts not a good thing, I have to ask?
This economists reasoning is that it will reduce revenue for the state, which supposedly isn't a good idea in a recession. I am absolutely flabbergasted by this nonsense. It is during an economic downturn that the government should be more willing to do without, not just for moral reasons. The government does NOT produce or create economic growth, whereas taxpayers do. It therefore makes more sense to have money in the hands of producers in an economic downturn than in the hands of economic consumers (the government).
The existence of government is not a worthy goal compared to the survival of taxpayers. We, taxpayers, do not exist to sustain the government. The government exists to provide very basic services for us. If you buy the notion that the government generating revenue is the important economic goal, then this economist is right. If, however, you believe that it is far better for taxpayers to survive and thrive, then he is way off, suggesting that the government can't do with less.
It's time for the government to do with a lot less and stop making us do with less.

It's never too late, though. We could raise the severance tax more since the price of natural gas is down and it's not going to produce as much revenue for the government as hoped, which is the reason why natural gas businesses exist (to produce revenue for the government). It's not possible, I'm sure, that raising the costs of natural gas drillers (severance tax) hurt the industry in any way, though.
FYI, I told you this would happen. It was all the way back in March that I pointed out that the price of natural gas has NEVER stayed above $8 for an extended period. Somehow, we were sold a bill of goods that it would stay high forever. Of course, it's easy to predict that what goes up must come down, but I was saying this when all the experts were saying it was going to go up forever. Also all the way back in March, that I explained the economics of the oil bubble.

I'm serious. We're told all the time by liberals that American auto manufacturers have to make cars like Toyota because, supposedly, their problem is that they make cars people don't want. So, how can Toyota's sales be down more than Ford's, which are only down 30%. How can Toyota's sales possibly even be down? Liberals want to dictate, literally, what the Big 3 make.Toyota's sales are down, but they aren't in as much trouble because, unlike the Big 3, they don't have the same ridiculously high cost structure. Democrats ARE NOT going to touch that, though, because it illustrates that unions are to blame. The Big 3's have a cost structure which is nearly 80% higher than foreign manufacturers. It's because of union concessions that the Big 3 made during good times. These same union albatross contracts that are killing the American auto industry are the same thing that killed Michigan. They're the same reason that automakers don't open new plants in Michigan and why heavily unionized states all over the country are languishing far more than Right to Work states.
Now, democrats want to kill that, too, by giving unions a huge leg up over businesses, with the "Employee FREE Choice Act".

I find it very interesting that Big Labor is claiming an "undue burden" because of the current law's 40 day requirement before a union vote may be held with secret ballots.Does it put an undue burden on a political party to prevent them from announcing an election any time they want and requiring secret ballots?
Are we to believe that unions won't organize before the day they decide to spring an election on the business owner? How does this not place an undue burden on the business owner who will find out the day of that they have to organize for a union election?
Do we really want unions to do for other businesses and states what they did for the Big 3 and Michigan?
It's with these questions and many others that I breath a sigh of relief that moderate Mark Pryor might be moderating his position, that he might not vote for this tyrannical payoff to unions.

UPDATE: Too Little, Too Late: Gov. Beebe Cancels Meeting With Obama
Note that Gov. Beebe doesn't want to be tied to Barack Obama, who is hugely unpopular in Arkansas, outside of a few pockets.Too bad for Gov. Beebe that he campaigned for Obama, who will be the worst, most liberal (same thing) president since Jimmy Carter. It's too late now for Gov. Beebe to try to distance himself from Obama.
News today has reframed this as the Guv not going because of weather. That's convenient. FYI, it's 41 degrees in Chicago, where Beebe was to make his connecting flight. Yesterday, when the Guv was supposed to be in Chi-Town it was 35 and "windy". It's always windy in the Windy City, hardly a reason to worry about the weather. Are we really to believe that he couldn't find another flight to Philadelphia?

Arkansas Tax Revenue Beats Last Year, Still No Significant Tax Cuts For Struggling Arkansans
So far, Gov. Beebe is acting as if he's very magnanimous to give us one more penny off the state sales tax on groceries. I'm pretty sure he campaigned 2+ years ago on cutting the whole thing. Arrest Warrant Affidavit For Anne Pressly Murderer/DNA Evidence and Sexual Assault...

Curtis Vance apparently consented to DNA swabs when police interviewed him. The samples matched those taken from Pressly at St. Vincent's. The State Crime Lab verified the DNA evidence, which was the basis for the warrant.
